SoundMadeSeen ABN: 20 198 657 950 ("SoundMadeSeen," "we," "us") is the Developer of GuestsMadeSimple, a web application ("Web App") that helps podcast hosts manage their guests — from initial contact through intake, scheduling, recording, and publishing.
By accessing and using the Web App, you agree to these Terms and Conditions, forming a legally binding agreement between SoundMadeSeen and you, the User. Please carefully review these Terms before using the Web App.
2.1 SoundMadeSeen grants Users access to the Web App at https://guestsmadesimple.com/ to facilitate the management of podcast guests and related workflows.
2.2 The Web App is tailored for podcast hosts and producers, offering a suite of tools and functionalities aimed at streamlining guest intake, scheduling, communication, and content sharing.
2.3 Users must adhere to all terms and conditions outlined herein while utilising the Web App.
2.4 This encompasses respecting copyright laws, ensuring the accuracy of information provided to and about guests, and maintaining ethical standards in content creation and communications.
2.5 By using the Web App for guest management purposes, Users acknowledge their responsibility to operate in a manner that aligns with legal and ethical guidelines, including obtaining all necessary consents from their guests.
3.1 Users can create custom intake forms and send them to invited guests to collect bios, headshots, social links, and answers to host-defined questions.
3.2 Users can publish a public booking page so guests can self-book recording times against host-defined availability, taking into account each party's timezone.
3.3 Users can manage their roster of guests and episodes through the Web App, including scheduling, status tracking, and reminder workflows.
3.4 Users can build and share guest-facing "share kits" containing prep materials, audio, transcripts, and promotional assets.
3.5 Users on eligible plans can configure custom branding, send automated reminder emails, and integrate with third-party services such as podcast hosts and calendar tools.
3.6 The Web App provides team collaboration features so multiple members of a podcast team can manage shows together, subject to plan limits.
3.7 SoundMadeSeen may add, modify, or remove features from time to time. Where a change materially reduces functionality of a paid plan, we will give reasonable notice.
3.8 Users on eligible plans can configure Release Forms to be electronically signed by guests through the Web App. See clause 19 for the full terms governing Release Forms and electronic signatures.
4.1 The Web App generates public-facing URLs for intake forms, booking pages, and share kits so guests can complete their portion of the workflow without requiring an account.
4.2 By publishing such pages, Users acknowledge that the information they include on those pages will be accessible to anyone with the URL.
4.3 Users are solely responsible for ensuring that information published to public-facing pages does not infringe any third party's rights or breach any law.
4.4 Users retain full ownership and control over the content shared via these pages. SoundMadeSeen does not claim any rights or ownership beyond the scope necessary to provide the services outlined in these Terms and Conditions.
4.5 SoundMadeSeen is not liable for any issues arising from the use of public links, including but not limited to unauthorised access by third parties to whom Users disclose the URL.
5.1 SoundMadeSeen offers various subscription plans with limits on the number of shows, team members, and guests per month, as outlined at https://guestsmadesimple.com/pricing.
5.2 A free tier is available with limited features. Paid plans unlock additional features and higher limits.
5.3 Subscription tiers and pricing are listed on the pricing page above and may be updated from time to time.
5.4 The Service or some parts of the Service are available only with a paid Subscription.
5.5 Users will be billed in advance on a recurring and periodic basis (monthly or annually), depending on the type of Subscription plan selected.
5.6 At the end of each period, your Subscription will automatically renew under the same conditions unless you cancel it or SoundMadeSeen cancels it.
5.7 SoundMadeSeen may also offer lifetime-access deals via third-party platforms (such as AppSumo). These are governed by the terms shown at the time of redemption and by the relevant platform's refund window.
5.8 Uploaded files (including guest headshots and share-kit assets) belonging to inactive accounts may be periodically removed to preserve storage space, in accordance with retention windows tied to the plan tier.
5.9 SoundMadeSeen will send an email at least 5 days before content removal takes place.
5.10 Payment processing is handled through Stripe, allowing credit and debit card payments. Card details are collected and held by Stripe; SoundMadeSeen does not store full card numbers on our servers.
6.1 SoundMadeSeen does not charge any cancellation fees or penalties when terminating a subscription.
6.2 Users only need to wait until the end of the current billing period for the cancellation to become effective.
6.3 Users can cancel their subscription renewal either through their billing settings page or by contacting SoundMadeSeen.
6.4 Users will not receive a refund for fees already paid for their current subscription period (subject to clause 12). They will retain access to the Service until the end of their current subscription period.
7.1 Users must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms and may result in immediate termination of their account.
7.2 Users are responsible for safeguarding the password used to access the Service and for any activities or actions under their password.
7.3 Users agree not to disclose their passwords to any third party and must notify us immediately upon becoming aware of any breach of security or unauthorised use of their account.
7.4 Users may not use as a username the name of another person or entity that is not lawfully available for use, a name or trademark subject to any rights of another person or entity, or a name that is offensive, vulgar, or obscene.
8.1 Users have the right to upload content to the Web App ("Customer Data"), including show details, episode metadata, intake responses, headshots, and share-kit assets, and they are responsible for its legality, reliability, and appropriateness.
8.2 By uploading content, Users grant SoundMadeSeen a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and display that content solely as necessary to provide the Service.
8.3 Users retain ownership of their content and confirm that it does not violate anyone else's rights.
8.4 Users (hosts) are responsible for obtaining all necessary consents from their podcast guests before uploading their personal information (including names, emails, headshots, bios, and intake responses) to the Web App.
8.5 Users warrant that their collection and use of guest personal information complies with all applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to the User.
8.6 Users are solely responsible for the content they upload.
8.7 Users may not upload unlawful, offensive, or spam content.
8.8 Users may not upload content that is intentionally misleading, harmful, defamatory, or that impersonates other individuals or organisations.
8.9 Users may not use the Service to send unsolicited communications in breach of the Spam Act 2003 (Cth) or equivalent law.
8.10 SoundMadeSeen reserves the right to remove or edit content that violates these terms.
8.11 Posting or uploading objectionable content may result in limitations or revocation of access to the Web App.
8.12 The Web App itself, including its design, code, graphics, and trademarks, is the property of SoundMadeSeen or its licensors, with all rights reserved.
8.13 Users may not copy, modify, publish, distribute, or sell any part of the Web App without our prior written permission.
8.14 While SoundMadeSeen regularly backs up content, we cannot guarantee against any data loss or corruption.
8.15 Backup issues may arise due to corrupt or changing content during backup.
8.16 SoundMadeSeen supports and troubleshoots backup issues but is not liable for content integrity or restoration failure.
8.17 Users agree to keep a complete and accurate copy of their content outside the Service.
9.1 SoundMadeSeen employs encryption in transit, secure data storage solutions, and regular system updates to guard against unauthorised access.
9.2 SoundMadeSeen plans to implement audits to enhance data security further when resources permit.
9.3 SoundMadeSeen's database is regularly backed up and stored in a secure location. Uploaded files (such as guest headshots) are stored on Cloudflare's R2 system, which maintains robust backup protocols.
9.4 These platforms adhere to industry-standard security protocols to protect data from unauthorised access, disclosure, alteration, or destruction.
9.5 Access to databases containing User data is strictly limited to authorised SoundMadeSeen personnel who require access for legitimate business purposes.
9.6 Access controls are implemented based on the principle of least privilege, ensuring that personnel access only the data necessary for their roles.
9.7 SoundMadeSeen collects only the personal data necessary for providing our services. See our Privacy Policy for full details.
9.8 SoundMadeSeen acknowledges the importance of compliance with data privacy regulations and is committed to meeting its obligations.
9.9 User data is kept only for as long as necessary for the purposes for which it was collected or as required by law.
9.10 User data is processed lawfully, fairly, and transparently, with measures in place to ensure data accuracy, integrity, and confidentiality.
9.11 User data is stored within the Web App for the duration of the User's subscription period.
9.12 SoundMadeSeen reviews data regularly and deletes it when it is no longer needed to ensure compliance with privacy regulations.
9.13 If a User requests the deletion of their data, SoundMadeSeen will promptly comply with the request, ensuring secure and irreversible deletion of all User data from our active systems, except where retention is required by law.
9.14 Users may either email us at rane@guestsmadesimple.com or submit a request through our support page.
10.1 SoundMadeSeen conducts regular checks to ensure the accuracy and integrity of the data presented within the Web App. These checks are designed to maintain the reliability of our Service and provide Users with confidence in the information displayed.
10.2 SoundMadeSeen offers technical support to subscribers using the Web App.
10.3 Users can access technical support via email at rane@guestsmadesimple.com to address any questions, concerns, or issues they may encounter while using GuestsMadeSimple.
11.1 While SoundMadeSeen endeavours to provide consistent support, maintenance, and technical assistance, there may be instances beyond our control that prevent us from fulfilling these commitments. In such cases, SoundMadeSeen shall not be held liable for any damages, losses, or disruptions resulting from circumstances including but not limited to server outages, technical failures, or force majeure events.
11.2 SoundMadeSeen reserves the right to modify, suspend, or discontinue support, maintenance, or technical assistance temporarily or permanently without prior notice. We will make reasonable efforts to notify Users of any such changes in advance whenever feasible.
11.3 Users acknowledge and agree that SoundMadeSeen's liability is limited to the extent permitted by law.
11.4 SoundMadeSeen shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with the use of the Web App, except to the extent such liability cannot be excluded by law.
12.1 SoundMadeSeen does not offer refunds for subscription payments except under the specific circumstances outlined below.
12.2 Users may be eligible for a full refund if they cancel their subscription within 72 hours of the initial subscription payment.
12.3 After the initial 72-hour period, no refunds will be issued for either monthly or annual subscriptions.
12.4 Users are encouraged to review the subscription details and terms before committing to ensure the plan meets their needs and expectations.
12.5 SoundMadeSeen reserves the right to modify this refund policy at any time. Any changes will be communicated to Users via email or through the platform.
12.6 Nothing in this Refund Policy or these Terms and Conditions limits or modifies the User's statutory rights under the Australian Consumer Law (ACL) or other applicable consumer protection laws.
12.7 Requests for refunds must be submitted via email to rane@guestsmadesimple.com.
13.1 SoundMadeSeen strives to provide accurate and up-to-date information through its Web App and associated services.
13.2 While we make every effort to ensure accuracy, we do not guarantee the completeness, correctness, or reliability of any information on the Web App.
13.3 SoundMadeSeen does not guarantee specific earnings, audience growth, or business outcomes from using the Web App.
13.4 SoundMadeSeen is not responsible for the accuracy or legality of third-party content or services integrated into the Web App (including third-party podcast hosts, calendar providers, and analytics services).
13.5 SoundMadeSeen disclaims liability for consequences resulting from decisions made based on information provided by the Web App.
13.6 Users are solely responsible for the use of information obtained through the Web App.
13.7 SoundMadeSeen reserves the right to make changes or updates to the Web App without prior notice.
13.8 SoundMadeSeen disclaims any liability for issues arising from software updates or modifications.
14.1 SoundMadeSeen promptly responds to intellectual property infringement claims. If you believe content on our Service violates your copyright, email the details to rane@guestsmadesimple.com.
14.2 The Web App and its original content are the exclusive property of SoundMadeSeen and its licensors.
14.3 The Web App is protected by copyright and trademark laws, and our trademarks may not be used without prior written consent.
15.1 By accessing and using the Web App, Users acknowledge that they have read, understood, and accepted these Terms and Conditions, including the Refund Policy and Disclaimer.
15.2 Users agree that their use of the Web App is at their sole risk.
These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

19.1 Users on eligible plans can configure release forms ("Release Forms") to be electronically signed by their podcast guests through the Web App, with the typed signature, timestamp, IP address, browser/user-agent, and document version captured for evidentiary purposes.
19.2 A Release Form executed through the Web App is an agreement between the User (host) and the guest. SoundMadeSeen / GuestMadeSimple is not a party to this agreement and provides only the infrastructure to record the agreement and capture an evidentiary record of consent.
19.3 Users are solely responsible for the content of their Release Forms, including ensuring that the form's terms are accurate, lawful, and appropriate for the use case, and that the rights granted by the form are sufficient for the User's intended use of the recorded content.
19.4 SoundMadeSeen may provide one or more default Release Form templates within the Web App. These templates are provided as a starting point only and do not constitute legal advice.
19.5 Users are strongly encouraged to obtain independent legal advice and to have any Release Form (default or customised) reviewed by their own legal counsel before relying on it. SoundMadeSeen makes no representation that any default template is suitable for any particular purpose or jurisdiction.
19.6 Electronic signatures captured through the Web App are intended to have legal effect under the Electronic Transactions Act 1999 (Cth) in Australia and equivalent state-based legislation, the Electronic Signatures in Global and National Commerce Act (15 U.S.C. §§ 7001 et seq.) in the United States, and Article 25 of Regulation (EU) No 910/2014 ("eIDAS") in the European Union, each of which establishes that an electronic signature shall not be denied legal effect solely because it is electronic.
19.7 SoundMadeSeen does not represent that signatures captured through the Web App constitute "qualified electronic signatures" within the meaning of eIDAS, nor that they meet any heightened evidentiary or formality standard that may apply in specific jurisdictions or contexts (including but not limited to deeds, notarisation, court-grade chain of custody, or instruments requiring witnessing).
19.8 Users are responsible for determining whether an electronic signature captured through the Web App is appropriate for the agreement they wish to record, and whether any heightened formality is required.
19.9 For each signed Release Form, the Web App captures a technical audit record including the typed signature, the date and time of signing in UTC, the IP address from which the signature was submitted, the browser and user-agent string, and the version of the document signed.
19.10 This audit record is intended as a technical record of the signing event and is not represented as a court-admissible chain-of-custody record. Users requiring court-grade evidentiary capture should use a third-party qualified electronic signature provider.
19.11 Signed Release Forms and their audit records are retained for the duration of the User's subscription period. Users are encouraged to download and retain copies of any signed Release Form outside the Web App.
19.12 If a User's account is closed, signed Release Forms may be deleted in accordance with the data retention provisions in clause 9 (Data Security, Privacy, and Global Compliance).
19.13 By signing a Release Form through the Web App, the guest acknowledges that they are creating an electronic signature with the legal effect described in clause 19.6, that the audit record described in clause 19.9 will be captured, and that the agreement is with the User (host) and not with SoundMadeSeen.
